C., wife of Śaṅnakīṣṇā V., two, Śrī Śaṅnakīṣṇā N., son of Nāgarāja P., number three, Śrī Vijayakumāra C., son of Śaṅnakīṣṇā N., and four, Śrī Sunil Kumar C., son of Śaṅnakīṣṇā N., all are residing at the Gundur village, Virgunagar post, Bengaluru, 560049. I do hereby issue this legal notice by calling upon both of you, these as earned in connection with the sale agreement dated 6th, 2022, for its cancellation, and as well as to proceed the alleged advance share conservation of rupees twenty lakhs paid away, both of you to my client. Just a moment. My client informs me that both of you have approached my client to purchase the converted land in survey number seven of Bengaluru village, Śrīdhare Oṅgarī, Utskote Taluk, Bengaluru district, measuring thirty-four quintals. For a total sale conservation of rupees one crore ninety lakhs. Just come. After both of you have satisfied with the documents maintained by my client, and after getting legal opinion from your end, both of you have decided to purchase these property in percent from my client for the above-said sale price. And accordingly, after all negotiations held between you and my client, comma, the sale tax have been withdrawn into writing under the agreement of sale dated 22-6th, 2026, and accordingly the sale agreement came to be registered in the office of the Sabarī-stāra, Utskote, wider. While origin number HHK-1-04195-2022-2023, comma, book number one, comma, stored in CD number HHKD-1569, comma, registered in the office of the Sabarī-stāra, Utskote, on 22-6th, 2022, Utskote. Under the said sale agreement, comma, you have paid twenty lakhs by way of cheques to my clients, comma. Thereafter, out of the said three cheques, comma, the cheque bearing number 232570, dated 25-6th, 2022, drawn on Punjab National Bank, Devananda Bank's index came to be withdrawn for want of funds. And therefore, when my clients intimated the same to you, comma, you have paid the said five lakhs, covered under the said cheque, and received that cheque from my clients. In all my clients I have received twenty lakhs out of one crore ninety lakhs from you. Two stuff. And as to my clients, covered under the said that. In terms of clause three, comma, clause 3.1, comma, the time has been fixed for performance of the contract of the sale agreement within two months, from the date of sale agreement. Two stuff. As on the date of sale agreement dated 22-6th, 2022, my clients have furnished all those relevant documents to you, comma, upon satisfying the said documents only, you have entered into sale agreement with my client to purchase the scheduled property. Two stuff. Even though my clients have furnished all the said documents, comma, both of you did not permit to my clients to get the sale deed re-inserted from my client by paying the balance of the sale-consolidation of this one crore seventy lakhs. Two stuff. Next. My clients further instructed me to state that, comma, despite my clients' persistent and continuous request and demands with you to get the sale deed from my clients by paying the balance sale-consolidation of rupees one crore seventy lakhs, comma, but both of you, both of you, on one or the other pretext went on dragging the issue in question in a not coming forward to get the sale deed from my client by paying the balance sale- consolidation of rupees one crore seventy lakhs within two months. And even thereafter, to a lapse of two months also, you did not permit to my clients to get the sale deed from them. Two stuff. Very strangely, on 26-12th, 2023, the first of you, without the participation of second of you, has got issued a legal notice that you, my clients, through the learned advocate to be N. C. Santosh Kumar, Rasputin, calling upon my clients, calling upon my clients to come forward to approve the sale deed in terms of the Shraddha, Shaila Girman dated 22-06-2022 by punishing all the documents which have been indicated in your notice at item number one to eleven. Comma, in spite of my clients' permission, the required documents. On seventh May, twenty-twenty-four, comma, both of you did not come forward to get the śarjita registered from my client. No stuff. Just it shows your conduct, that you never ready and willing to get the śarjita from my client. Comma, by paying a meager amount of rupees twenty lakhs to my clients and avoiding to purchase the property from my client by paying the balance of consideration of rupees, one crore seventy lakhs. And you need my clients to wait even after two and half years. No stuff. Just… Both of you are dragging the matter like anything, and based on the set of fraudulent sale agreement that they got, twenty-two-six, twenty-twenty-two, you people are pressing my clients on one or the other pretext, that come and execute the sale deed on so many times, including issuance of abortion notice by your ends. No stuff. Even though my clients were ready to execute the sale deed, by receiving these advance, I mean, balance of consideration of rupees one crore seventy lakhs, and accordingly my clients have permitted the documents required by you to get this sale deed registered. But thereafter, both of you have not shown any readiness, willingness to get this sale deed from my clients. Thus, both of you have caused a great financial loss to my clients, and you need my clients to wait more than two and half years from the date of sale agreement, comma, whereby the alleged sale agreement, whether twenty-two-six, twenty-twenty-two, is hereby terminated, slash, re-skinned, slash, cancelled by issuing this legal notice to both of you, and so also the alleged advance sale consideration paid by you of rupees twenty lakhs is hereby forfeited, and you have lost to… You have lost to… You have lost the right to purchase the settlement property from my clients. And the very first option which has been made in Class 3, comma, 3.1 of the, one of the, one of the sale agreements is only two months. But you have issued the legal notice, calling upon my clients on 16th of 2023. Comma, thus the issuance of this legal notice is also outside the purview of law, purview of law, and opposite to Section 16, comma, 19 and 20 of Specific Law of Act. And therefore, left with no other option, my clients have issued this legal notice intimating both of you that they have cancelled the sale agreement they did, twenty-two, six, twenty-twenty-two, and forfeited the alleged advance sale consideration of rupees twenty lakhs. And thereby, both of you have no right to make any further correspondence with my clients. And accordingly, if required, both of you have to come forward to get the sale agreement cancelled and fix the date and time. Then you would come and sign to the cancellation of sale agreements at the cost of my clients. And you shall not insist to refine the alleged advance sale consideration of twenty lakhs from my clients. As both of you have already put my clients in dark throat for a period of two and a half years, and therefore you have lost the right to purchase the federal property from my clients. Please stop signing this notice. Therefore I hereby call upon both of you to come forward to execute the cancellation of the sale agreement they did, twenty-two, six, twenty-twenty-two, without insisting upon refund of the alleged advance sale consideration of rupees twenty lakhs, as my clients have already forfeited the advance sale consideration of rupees twenty lakhs from… Twenty lakhs covered under the said sale agreement. And also my clients are hereby terminated slash rescinded, rescinded slash cancelled the sale agreement dated twenty-two, six, twenty, twenty-two by forfeiting the advance sale consideration of rupees twenty lakhs. And thereby you are further called upon to intimidate my clients for your arrival to my clients to sign the cancellation of sale agreement and fix the date and time and please come and execute the cancellation of sale agreement, sale agreement in favor of my clients within fifteen days from the date of receipt of this Nṛsiṁha notice, failing to do so, my clients will be constrained to approach competent court of law for cancellation of the sale agreement and also for damages which you caused a great delay of two and a half years from the date of entering into sale agreement unnecessarily and put my clients in a great financial crisis. How come both of you have to pay the charges of this Nṛsiṁha notice of rupees fifty thousand each, that is one lakh, one lakh rupees, one lakh rupees, one lakh has to be paid by both of you to my clients without fail.
